PacketScan Terms of Service

Please read carefully before using this Service.

PacketScan (this Service) is owned and operated by Bik Pro, LTD. If you (the User) do not accept the Terms of Service, or comply with the provisions, you may not use this Service.

Description of Service

PacketScan is a network packet analysis platform. Users have the ability to upload packet captures to the PacketScan service, where they are uploaded, compressed with unique user mutable key, analyzed and then could be download to the user medium (any kind of user means to access and communicate with this Service), cataloged (with added metadata) and presented in a archived web or other readable formats, depending of the user's data content. Users can then analyze and annotate the packet captures from anywhere, on any device that supports a compatible web browser.

The service uses Cookies (transmitting between the server and the browser, only as the basic technical mean to provide the Service, as follow:

• User's registration (sign-up)
• User credentials recovery, in case of forgotten by the User username and/or password
• Maintaining the session, when the User utilizes the system (in signed-in user's state)

The duration of the conformation of the new user registration (through the link, sent to the given by the User e-mail in the application) has been set to 24 hours, since the timestamp of the e-mail sent by the Service. After this period, the link will expire and the attempt of the new user registration will be discarded.

Every User can change its username, password for the authorization to access to the Service, e-mail and zip-password (for the decryption of the results of the analysis).

All uploaded files by the User will be deleted, once their analysis will be completed.

The result of the analysis will be encoded (with a password) and will be stored (for the download by the User) for a period of 24 hours. After that period, the result will be deleted.

Every User can send up to 2 messages (with maximal size of each message up to 1000 UTF-8 symbols) in 24 hours, to the Maintenance team, with preset of subjects: General, Feedback, Issue

After registration, to every registered user, using this Service "Free of charge" subscription:

• A quota to upload of 500 MB (The quota will be applied to User's temporary storage capacity and to the max size of the upload during the calendar month (30 days), counting from the date of registration
• Temporary storage of 500 MB for the next calendar day (or 24 hours) at the end of the month
• The maximum single upload size of 150 MB
• Partial file upload (to upload only the first N bytes of the file, where N is bigger number of: Free Storage Space or Maximum File Size
• Maximal uploads (uploaded files) per month (or 30 calendar days) is set to 150 files
• The upload folder capacity: up to 15 files

After registration, to every registered user, using this Service as "Professional" subscription:

• A quota to upload of 2000 MB (The quota will be applied to User's temporary storage capacity and to the max size of the upload during the calendar month (30 days), counting from the date of registration
• Temporary storage of 2000 MB for the next calendar day (or 24 hours) at the end of the month
• The maximum single upload size of 500 MB
• Partial file upload (to upload only the first N bytes of the file, where N is bigger number of: Free Storage Space or Maximum File Size
• Maximal uploads (uploaded files) per month (or 30 calendar days) is set to 500 files
• The upload folder capacity: up to 15 files

This Service use following third parties services and software as follow:

• The site and the temporary storage for uploading files and then to store analyzed, compressed and encrypted with user-specific password user data will be run over the hosting service provided be Ionos.com and defined as Hosting Premium
• Apache Server, PHP 7.0+, Linux operating system

Changes to Terms

BIK Pro, LTD may, at any time, for any reason and without notice, make changes to (i) this Service, including its look, feel, format, and content, (ii) the products and/or services as described in this Service, and (iii) these Terms of Service. Any modifications will take effect when posted to this Service. Therefore, each time the User accesses this Service, the User needs to review the Terms of Service, upon which access and use of this Service is conditioned. By the User's continuing use of this Service after changes are posted, the User will be deemed to have accepted such changes.

Content provided by the User

Users are responsible for their own content and that of third parties that they share through this Service, that they upload and post on or through PacketScan, or that they transfer by any other means. Users confirm that they have all the necessary consents from third parties whose data and/or content they share with BIK Pro, LTD and hereby indemnify BIK Pro, LTD for any liability or claim arising against BIK Pro, LTD in connection with illegal distribution of third-party content or unlawful use of the Service.

BIK Pro, LTD does not moderate the content provided by Users or by third parties but will act if complaints are received from Users or if orders are issued by the public authorities regarding content deemed offensive or illegal.

BIK Pro, LTD's use of content uploaded by Users, and User Information, is described in our Privacy Policy.

Security of Content and User Information

Though the Service is based on secure web technologies, BIK Pro, LTD provides no warranty and accepts no liability for the loss or breach of content uploaded or shared through this Service, nor does BIK Pro LTD provide any warranty or accept any liability for User data stored as a consequence of the use of this Service.

Users are responsible for keeping all capture files and associated data (for example, the capture URL) private, and are responsible for keeping all User information (including but not limited to email address, password) private.

BIK Pro, LTD's use of content uploaded by Users, and User Information, is described in our Privacy Policy.

Service Availability

This Service is provided "as is", and BIK Pro, LTD provides no express or implied warranty for accuracy or availability.

Deleting User Accounts and Account Termination

Registered Users can cancel their accounts and stop using this Service at any time by sending a cancellation request via email to support@packetscan.net.

Non-commercial Use

Users are not allowed to reproduce, duplicate, copy, sell, resell or exploit any portion of PacketScan without BIK Pro, LTD's express permission, granted either directly or through a proper reselling program.

You may not use this Service for commercial purposes without prior consent from BIK Pro, LTD.

Forbidden Use

The Service shall be used only in accordance with these Terms.

Users may not:

• reverse engineer, decompile, disassemble, modify or create derivative works based on PacketScan or any portion of it;
• circumvent any technology used by PacketScan or its licensors to protect content accessible via it;
• copy, store, edit, change, prepare any derivative work of or alter in any way any of the content provided through PacketScan;
• use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index any portion of PacketScan or its content;
• rent, lease or sublicense PacketScan;
• defame, abuse, harass, use threatening practices, threaten or violate the legal rights of others in any other way (such as rights of privacy and publicity);
• disseminate or publish content that is unlawful, obscene, illegitimate, defamatory or inappropriate;
• use PacketScan in any other improper way that violates these Terms.

Limitation of Liability

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. BIK Pro, LTD SPECIFICALLY DISCLAIMS ANY LIABILITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO, USE OF OR RELIANCE ON THE CONTENT (EVEN IF BIK Pro, LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) OR THAT ARISE IN CONNECTION WITH MISTAKES OR OMISSIONS IN, OR DELAYS IN TRANSMISSION OF, INFORMATION TO OR FROM THE USER, ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION OR DELIVERY, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORDS, PROGRAMS OR FILES, INTERRUPTIONS IN TELECOMMUNICATIONS CONNECTIONS TO THE SERVICE OR VIRUSES, WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, TELECOMMUNICATIONS FAILURE, THEFT OR DESTRUCTION OF, OR UNAUTHORIZED ACCESS TO THE SERVICE OR THE CONTENT. THIS LIMITATION OF LIABILITY MAY BE DIFFERENT IN CONNECTION WITH SPECIFIC PRODUCTS AND SERVICES OFFERED BY BIK Pro, LTD. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THIS LIMITATION MAY NOT APPLY TO YOU.

Indemnity

You agree to defend, indemnify, and hold BIK Pro, LTD, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Service.
